Pemberton for MA (the “Campaign,” “we,” “us,” “our”) is firmly committed to safeguarding the security and privacy of visitors to our websites, mobile sites, and other Internet sites and applications that link to this policy (collectively, the “Site”). This Privacy Policy and Terms of Use (the “Policy”) explains how we use information you provide while visiting our Site, and applies to your access to and use of the Site. We may modify this Policy from time to time, so we encourage you to check this page for updates.  

How We Use Your Information

We are committed to protecting your privacy.

When you register, contribute, make a purchase, sign up to volunteer, communicate with us via third party Internet sites, or take any other action on our Site, we may collect information about you, such as contact information, including your name, address, telephone number and/or email address, and any other information you choose to share. We also may obtain information about you from outside sources and add it to or combine it with the information we collect through this Site. We are required by federal campaign finance law to use our best efforts to collect and disclose certain information, including the name, mailing address, occupation, and employer of all individuals whose contributions exceed $200 per election cycle.

We use this information to operate the Site, send you news and information about the Campaign and other candidates, issues, and organizations that we support, solicit your participation in our programs, events, and activities, obtain and confirm your attendance at events, contact you if federal campaign finance laws require us to request additional information from you, and for other purposes described in this Policy or described to you at the time the information is collected. Submitting your personal information will sign you up to receive emails and/or calls. 

Cookies, Advertising, and Data Tracking

A cookie is a piece of data stored on the user’s hard drive containing information about the user.

Our Site uses a cookie and may use other similar tracking tools for measuring aggregate web statistics, and traffic, and other information. We also use cookies to facilitate your online visit by maintaining data that you provide for online activities for your convenience so that you will not need to resubmit certain information.

We may also use third-party services such as Google Analytics that collect information about you and your website use. This helps us understand traffic patterns and know if there are problems with our Site. We may also use tools in emails to track information about our mailings for various reasons. We are not responsible for and do not control how third-party services use your information.

We may place online advertising with third parties which will be shown on other sites on the Internet. In some cases, those third parties may decide which ads to show you based on your prior visits to the Site. At no time will you be personally identified to those third parties, nor will any of the information you share with us be shared with those third party vendors. We log standard technical information, such as your IP address and the kind of browser you use. We log this information for troubleshooting purposes and to track which pages people visit in order to improve the Site. We do not use log files to track a particular individual’s use of the website.

We may share information about you: with candidates, political committees, organizations, groups, causes, and websites that we believe have similar viewpoints, principles, or objectives; with vendors, service providers, volunteers, and consultants who need access to such information to carry out work on our behalf; to report information to the Federal Election Commission required by law; when we have a good-faith belief that sharing your information is appropriate to comply with the law or lawful government request or demand; to protect our rights or property, or to protect our supporters from fraudulent, abusive, or unlawful conduct; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires or justifies disclosure.

If you sign an online petition, you understand that such petition is public information and that we may make the petition, and your name, city, state, and any comments provided in connection therewith publicly available. In addition, we may provide such petitions or compilations thereof, including your comments, name, city, and state to national, state or local leaders, or to the press.

The Site may use social media plugins that let people share actions they take across web. Plugins may share your browsing information with the social media sites even if you do not click on the plugin or are logged out of your social media account.

How We Protect Information You Provide

We use industry standard security measures to protect against the loss, misuse or alteration of the information under our control. Although we make good faith efforts to store information collected in a secure operating environment, including environments operated by third parties, we cannot guarantee complete security.

When you make a contribution through this website, we collect credit card information from you. That information is used solely for processing your contribution; is not maintained by us; is transmitted via third-party payment processing provider (and according to the payment processing provider’s security protocols) for processing, and is never disclosed to anyone for any other purpose other than for processing your contribution under any circumstance.

Links to Other Websites and Third Party Information

This Policy applies to the Site and its subdomains, and not any third-party sites. The Site links to third-party websites. We are not responsible for the content or privacy policies of these third-party sites. We encourage you to read the privacy policies and review the practices of all websites you visit.

The Site may provide information about third parties, such as other organizations, events, products, services, or activities. We provide this information as a service to users who may be interested in such information. We make no representations or warranties of any kind regarding third party content, and we are not responsible or liable for any third party content, events, products, services, or activities. Use of third party content and interactions with third parties are at your own risk.

Mobile Communications

With your consent, we may send promotional and non-promotional SMS and text messages and push notifications and alerts to your mobile device. You can deactivate push notifications and alerts at any time by changing the notification settings on your mobile device.  By providing your phone number, you consent to receiving recurring SMS and text messages. Transfer of Information to the United States

The Campaign is based in the United States, and is directed to U.S. residents. We receive and store information in the United States. If you are located outside of the United States, we and third parties working for us may transfer your information to, or store or access your information in, jurisdictions that do not provide the same level of data protection as your home jurisdiction.

Special Notice to Parents

We want to help you guard your children’s privacy. We encourage you to talk to your children about safe and responsible use of their personal information while using the Internet. We do not knowingly collect, use or distribute children’s personally identifiable information to any third parties. If you have any reservations, questions or concerns about your child’s access to the Site or how information that your child provides is used by us, please contact us.

Copyright and Trademarks

The Site and its content are the property of the Campaign and are protected by copyright, trademark, patent, and/or other intellectual property laws and international conventions. Subject to your compliance with this Policy, you are granted a limited, non-sublicensable, nontransferable, nonexclusive license that may be revoked at any time and for any reason, to access the Site and use the Site for your own personal noncommercial purposes. Any use of the Site for any other purpose without the prior written consent of the Campaign is strictly prohibited.

All logos and slogans contained on the Site are trademarks of the Campaign or third parties and may not be copied, imitated, or used, in whole or in part, without the prior written consent of the Campaign or the relevant third party.  

Submissions, User Content, and Take-Down 

When you provide us with information, such as feedback on the Site or other content submitted to the Campaign such as postings to the Site, this information is non-confidential and shall become the sole property of the Campaign. The Campaign shall own exclusive rights to such information, including any intellectual property rights, and may use and disseminate the information for any purpose and without any payment to you or prior notification.

By using the Site, you agree not to post, upload, transmit, distribute, store, create, or otherwise publish or submit solicitations or promotions, viruses or other harmful, disruptive, or destructive data, private information of any third party, or any content that:

  • is objectionable or that restricts or inhibits other users from using and enjoying the Site; 
  • is fraudulent, inflammatory, unlawful, defamatory, libelous, obscene, profane, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, deceptive, misleading, or that encourages or facilitates a criminal offense or the violation of any right or federal, state, local, or international law; 
  • infringes any patent, trademark, trade secret, copyright or other intellectual property right or proprietary right;
  • impersonates any person or entity or that misrepresents an affiliation or relationship with any person or entity; 
  • may expose the Campaign or third parties to harm or liability of any type; or  
  • otherwise violates this Policy.

The Campaign is not responsible or liable for any user content. The Campaign may, in its sole discretion, remove, screen, or edit any user content for any reason and without notice, including due to the content violating this Policy. The Campaign may also, in its sole discretion, terminate or suspend any user’s right to use the Site. 

Claims of Copyright Infringement

The Digital Millennium Copyright Act provides recourse for copyright owners who believe that material appearing on the Internet infringes on their rights under U.S. copyright law. If you believe in good faith that materials on the Site infringe your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. Notices and counter-notices must meet the then-current statutory requirement. Notices may be provided by certified mail to the Campaign’s/DMCA Administrator: Copyright Manager, Pemberton for MA, Inc., PO Box 1415, Framingham, MA, 01701. If you knowingly make misrepresentations in your notification, you may be liable for any damages, including costs and attorneys’ fees, incurred as a result of such notification.

Disclaimer of Warranties

The Site, materials contained therein, and provided in connection with the Site are provided “as is.”  The Campaign does not make any express or implied warranties, representations, or endorsements whatsoever regarding such materials.  

The Site may include inadvertent inaccuracies or errors. Additionally, the possibility exists that a third party could make unauthorized alterations to Site content or features. Although we attempt to ensure the integrity of the Site, we make no guarantees as to its completeness or correctness. In the event that a situation arises in which the Site’s completeness or correctness is in question, please contact us with, if possible, a description of the material to be checked and the location (URL) where that material can be found, as well as information sufficient to enable us to contact you.

Limitation of Liability

The Campaign nor any of its affiliates, directors, officers, employees, consultants, vendors, or volunteers are responsible or liable for any damages of any kind arising out of or relating in any way to the Site, any linked website, or any content or service available through the Site. The Campaign cannot and does not represent or warrant that the Site is free of viruses or other harmful components. 

Indemnification

By using the Site, you agree to defend, indemnify and hold harmless the Campaign and its affiliates, directors, officers, employees, consultants, vendors, and volunteers from and against any claims, damages, costs, liabilities and expenses, including attorneys’ fees, arising out of or related to any content you post, store or otherwise transmit on or through the Site, and your use of the Site.  

Administrative Provisions

This Policy constitutes the entire agreement between the Campaign and you with respect to your use of the Site. If for any reason a court of competent jurisdiction finds any provision of this Policy to be unenforceable, the Policy will be enforced to the maximum extent permissible so as to affect the intent of the Policy, and the remainder of the Policy will continue in full force and effect. Any failure by the Campaign to enforce or exercise any provision of this Policy or related right will not constitute a waiver of that right or provision.

This Policy and your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to this Policy shall be filed only in the state and federal courts located in the Commonwealth of Massachusetts and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of this Policy.

We reserve the right to amend or otherwise update this Policy at any time. By using the Site, you consent to the collection and use of the information as we have described. If we change our policies and practices, we will post the changes to the Site so that you can always be aware of them.
